Growlee Terms of Service

General Terms

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the website Growlee operated by us. Growlee is an intermediary Service between Customers and Social Media Account Managers. Our Terms of Service serves to manage the use and access of Growlee dashboard and correspondence with our sub-contracted social media account managers (will be referred as "Services" after now). Your access to and use of Growlee is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use Growlee. By accessing or using Growlee you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access Growlee. "Growlee", "we", "us", “our” words in this terms, refer to Growlee company that is considered as the intermediary company that connects Social Media Account Managers to provide the customer with services listed on our website. "Services" in the terms refer to the actions committed by Social Media Account Managers to help you grow your social media account.A social media account owner, company, organization, or any other third party we refer to in these Terms are considered the "Customer". By being a customer, you become a member of Growlee community.

Social Media Account Managers

An Social Media Account Manager is granted access to the social media account(s) of the Customer, thus allowing for the fulfillment of Services. Every member of Growlee community is provided with a communication channel to an Social Media Account Manager. Social Media Account Managers in this Terms of Service are considered as a third-party, subcontracted person(s) that provides Services of Growlee for the Customer. When you use Growlee, your Customer Data is accessed discreetly by employees of Growlee and by sub-contracted Social Media Account Managers to enhance the quality of the Services. Growlee service is only available for the people who is older than eighteen years old. If children under eighteen has given us their information without consent of their parents, send us an email immediately at team@growlee.co . We will terminate the account immediately.

Termination

We may terminate or suspend access to Growlee immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach our Terms of Service.

Subscriptions and Refunds

You have to provide a valid credit card to pay for Growlee. You authorize Growlee to charge the card for the recurring subscription. You give us permission to enable payment processing firms to process your submitted payment. Subscriptions can be cancelled at any time you want but can not be refunded. You can stop monthly subscriptions anytime during the subscription period with no extra cost in the next months and you can’t claim current month’s fees. You have to pay fees until you cancel your subscriptions. Monthly subscriptions’ fees are collected on the specific day of subscription for each month. Yearly subscriptions’ fees are collected on the specific day of subscription for each year. Lifetime access’ fee is only for one time purchase. Regret for purchases will not be issued. No refund claims will be issued for any technical issues. Taxes are calculated based on the billing information you provide at time of purchase. Growlee does not issue refunds based on results, due to the numerous unmanageable parameters involved in the process.

Billing Cancellation Cases

1st Case - The Customer started monthly subscription package on August 15th 2018 but he cancelled on September 10th 2018: The Customer will pay for August 15th-September 15th period which is 1 month payment. The customer won’t be billed after September 15th. If you cancel during the month, you won’t be billed for the next month.

2nd Case - The Customer started monthly subscription package on August 15th 2018 but he cancelled on November 10th 2018: The Customer will pay for August 15th-November 15th period which is 3 months payment. The customer won’t be billed after November 15th.

3rd Case - The Customer started yearly subscription package on August 15th 2018 but he cancelled on November 10th 2018: The Customer will pay for August 15th 2018-August 15th 2019 period which is 1 year payment. The customer won’t be billed for next year. If you cancel during the year, you won’t be billed for the next year. If there is a refund process(it only happens if Growlee management decides so), the number of months service used and refund fee(5%) are being calculated based on non-promotional monthly price($99). For this example, yearly package*(5%) will be deducted first, then 3 months of non-promotional monthly fee 3*($99) will be deducted. The rest will be issued to the customer.

4th Case - The Customer purchased lifetime access package on August 15th 2018 but he applied for a refund on November 10th 2018: Normally the refund policy of Growlee indicates that the payments are non-refundable. Growlee management can look at refund application. If Growlee management decides to process a refund, the number of months service used and refund fee(5%) are being calculated based on non-promotional monthly price($99). For this example, lifetime package*(5%) will be deducted first, then 3 months of non-promotional monthly fee 3*($99) will be deducted. The rest will be issued to the customer.

5th Case - The Customer started monthly subscription package on August 15th 2018 but he cancelled on August 31st 2018: The Customer will pay for August 15th-September 15th period which is 1 month payment. The customer won’t be billed after September 15th. If you cancel during the month, you won’t be billed for the next month.

Security

In no event will Growlee, or its suppliers, or licensors, or Social Media Account Managers, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: any special, incidental or consequential damages; ( the cost of procurement or substitute products or services; for interruption of use or loss or corruption of data or access. Growlee shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law. Growlee is not officially affiliated with any social media website or any third-party partners in any way. If any security breach and loss of data take place, Growlee is not responsible for the outcomes following this event. Social Media Account Managers requires your Social Media username and password to get necessary information. Services provided by Social Media Account Managers of Growlee will not be held accountable to the Growlee Company. Growlee Company will not be liable for any damages incurred if such cases occur. Growlee will step in and take appropriate actions against the Customer or Account Manager depending on circumstance.

Profiles & Accounts

Any actions on your social media profile can’t be estimated and controlled. They only depend on the quality of your social media profile. Even though Growlee tries to provide the best Social Media Account Managers to fulfill services to the customer, Social Media Account Managers may not fulfill their contractual obligations in any circumstances. Growlee will not be responsible if your social media account is daily banned or permanently banned for any reason. You agree that you will not hold Growlee accountable for any damages that may result because of Social Media Account Manager’s access to and use of your social media account. (although unlikely given the nature of our service).

Limitation of liability

Growlee was created for convenience of promoting your social media by Social Media Account Managers. Growlee does not encourage spamming or violation of Social Media Users’ rights or rules set by Social Media Website. Social Media Account Managers get attention of other users to your social media account but they can’t protect your account from spam and fake accounts because it is impossible to avoid them, nonetheless you can delete these spam and fake accounts manually or with other services. Given the nature of the service, no refunds will be issued based on results, nor do Account Managers guarantee any results. Account Managers don’t guarantee nonstop or error-free service. In no event shall Growlee aggregate liability for all claims relating to the services exceed one hundred US dollars.

Obligations

In case you change your social media password, your Social Media Account Manager can’t access to your social media account. In such action, you will have to login again with your new social media password to give access to your Social Media Account Manager. There will be inactive periods following this event, this inactive time will not be added to your account. If you choose to stop the platform for a specific period, the time of voluntary inactivity shall not be compensated. It is your responsibility to comply with Social Media Website rules and any legislation that you are subject to. We reserve the right to remove your account and ban you from using Growlee services at any point in time. In an unlikely event of this happening, your purchases will not be refunded. Growlee suggests that you explore Growlee service during your free trial before making any purchases in Growlee. By using and purchasing Growlee, you agree that you understand what you are purchasing and will not file a fraudulent dispute via any platform.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without any prior notice. It is your sole responsibility to check whether the terms have changed or right.

Inconsistencies and Agreement to Terms of Service

All the terms in this terms of service are constitutive of the entirety of our terms of service agreement between you as the Customer, us as the Company, and Social Media Account Managers as third parties that provide Services. In case of an conflict, or inconsistency, or claims that counter Terms of Service or Privacy Policy, the terms stated on this Terms of Service will be the prevailing agreement presented to any authoritative party considered as local jurisdictive parties.
